1.4 By accessing our website, creating an account, activating a test kit, placing an order, booking an appointment or using any of our services, you agree to be bound by these Terms and Conditions.

1.5 If you do not agree with these Terms and Conditions, you should not use our website or services.

“Doctor Review” means a service whereby a qualified medical practitioner reviews laboratory results and provides comments or guidance where that review is included with the selected test or purchased as an additional service.

“Healthcare Professional” means any nurse, phlebotomist, doctor or other appropriately qualified healthcare provider involved in delivering services.

“Home Visit” means a blood collection appointment conducted at a customer’s home or other agreed location.

“Laboratory” means any accredited pathology or diagnostic laboratory used by Easy Blood Check, including Inuvi and any future approved laboratory partners.

“Order” means any request placed by a customer for products or services supplied through Easy Blood Check.

“Sample” means blood, serum, plasma or any other biological specimen collected for laboratory testing.

“Services” means all products, testing services, appointments, consultations and healthcare-related services offered through Easy Blood Check.

“Website” means the Easy Blood Check website and any associated online portals.

“You” or “Customer” means the individual purchasing, activating or using the Services.

Eligibility

3.1 You must be at least eighteen (18) years of age to purchase or activate a testing kit unless a specific service expressly permits testing of minors and appropriate parental or guardian consent has been obtained.

3.2 You must provide accurate, complete and up-to-date information when:

  • creating an account
  • activating a test kit

booking an appointment.

3.3 Easy Blood Check reserves the right to refuse service where information supplied is incomplete, inaccurate or misleading.

3.4 Our services are intended for customers located within the United Kingdom.

3.5 Testing kits may only be dispatched to addresses located within the United Kingdom unless otherwise agreed by Easy Blood Check.

Important Medical Information

4.1 Easy Blood Check provides access to private laboratory testing and related healthcare services.

4.2 Easy Blood Check does not provide emergency medical treatment, emergency diagnosis or urgent care services.

4.3 Laboratory test results and general explanatory information are provided to help customers understand their laboratory findings. Where a Doctor Review is included, it is limited to the scope described for that service and does not provide emergency or urgent care.

4.4 Test results and any accompanying comments should not be regarded as a substitute for a full professional medical assessment, diagnosis, treatment or ongoing healthcare management where such care is required.

4.5 Blood test results must always be interpreted in the context of:

  • symptoms
  • medical history
  • medication use
  • lifestyle factors
  • physical examination findings

additional clinical investigations.

4.6 A result that falls within a laboratory reference range does not guarantee the absence of disease.

4.7 A result outside a laboratory reference range does not necessarily indicate the presence of disease.

4.8 If you have concerns regarding your health, symptoms or test results, you should consult your GP or another appropriately qualified healthcare professional.

4.9 If you believe you require urgent medical assistance, you should immediately contact:

your nearest Accident & Emergency department.

4.10 Easy Blood Check accepts no responsibility for any decision made by a customer who chooses not to seek appropriate medical advice after receiving test results or healthcare guidance.

Accounts, activation and orders

Customer Accounts

5.1 Certain Easy Blood Check services may require customers to create an online account.

5.2 Customers are responsible for maintaining the confidentiality of their account login details and passwords.

5.3 Customers must immediately notify Easy Blood Check if they become aware of any unauthorised use of their account.

5.4 Easy Blood Check reserves the right to suspend or terminate any account where fraudulent, unlawful or suspicious activity is suspected.

5.5 Customers are responsible for ensuring that all information held within their account remains accurate and up to date.

Test Kit Activation

6.1 Certain testing kits may require activation before a sample can be analysed.

6.2 Activation is the process by which a customer links a testing kit to their personal details and confirms their identity.

6.3 Activation helps ensure that laboratory results are matched to the correct individual.

6.4 Customers may be required to provide:

  • full name
  • date of birth
  • address
  • contact details
  • gender

other information required for laboratory identification purposes.

6.5 Failure to correctly activate a testing kit may result in:

  • delays to testing
  • inability to process a sample
  • requests for additional information

the need for a replacement sample.

6.6 Easy Blood Check accepts no responsibility for delays arising from incomplete or inaccurate activation information.

Who May Provide A Sample

7.1 The person providing a sample must be the individual whose personal details have been supplied during the activation process.

7.2 Customers must not submit samples on behalf of another individual unless expressly permitted by Easy Blood Check and all required consents have been obtained.

7.3 Easy Blood Check reserves the right to reject samples where identity verification requirements have not been satisfied.

Placing An Order

8.1 Orders may be placed through the Easy Blood Check website or through any other approved ordering channel.

8.2 Customers are responsible for reviewing their order carefully before submitting payment.

8.3 Customers should ensure that:

  • the selected test is appropriate for their needs
  • all personal details are correct
  • delivery information is accurate

appointment details have been reviewed where applicable.

8.4 Easy Blood Check shall not be responsible for errors arising from incorrect information provided by the customer.

Test Selection

9.1 Easy Blood Check provides access to a range of laboratory tests and health screening services.

9.2 Customers remain solely responsible for selecting the tests they choose to purchase.

9.3 Easy Blood Check does not guarantee that any specific test is suitable for any particular medical condition or purpose.

9.4 Customers who are uncertain about which test is appropriate should seek advice from a GP or other suitably qualified healthcare professional before purchasing.

9.5 Easy Blood Check reserves the right to refuse orders where we believe that a requested service is not clinically appropriate or cannot be safely provided.

Formation Of Contract

10.1 After an order is placed, customers will receive confirmation that their order has been received.

10.2 Acceptance of an order occurs only when Easy Blood Check issues an Order Confirmation or Acceptance Confirmation.

10.3 A legally binding contract between the customer and Easy Blood Check is formed only when the Acceptance Confirmation has been issued.

10.4 Easy Blood Check reserves the right to decline any order at its discretion.

10.5 If an order cannot be fulfilled, Easy Blood Check will notify the customer and any payment received will be refunded in accordance with the Refund Policy.

Payment

11.1 Payment must be received in full before any services are provided.

11.2 Easy Blood Check accepts payment methods displayed on the website at the time of purchase.

11.3 Easy Blood Check reserves the right to change accepted payment methods at any time.

11.4 Failure of payment authorisation may result in cancellation of the order.

Validity Of Tests

12.1 Unless otherwise stated, purchased testing kits remain valid for a period of one hundred and twenty (120) days from the date of purchase.

12.2 Samples must be collected and submitted within the validity period.

12.3 Expired testing kits may not be processed by the laboratory.

12.4 Easy Blood Check is under no obligation to replace, extend or refund expired testing kits.

12.5 Any extension granted shall be entirely at the discretion of Easy Blood Check.

Customer Acknowledgements

13.1 By placing an order, customers confirm that:

a) they have read and understood these Terms and Conditions;

b) they understand the limitations of laboratory testing;

c) they understand that test results are not a substitute for medical diagnosis;

d) they consent to laboratory analysis of submitted samples;

e) they consent to the processing of personal information in accordance with the Easy Blood Check Privacy Policy.

13.2 Submission of a sample for testing shall be deemed to constitute informed consent for the selected laboratory investigations.

Health information and personal data

Medical Questionnaires

14.1 In order to provide certain services, Easy Blood Check may request that customers complete a medical questionnaire.

14.2 Medical questionnaires may request information including but not limited to:

  • provide Doctor Review services
  • comply with legal and regulatory obligations

19.1 By purchasing a test, activating a testing kit or submitting a sample, customers acknowledge that relevant information may need to be transferred to the laboratory responsible for analysing the sample, in accordance with the Easy Blood Check Privacy Policy and applicable data protection law.

19.2 Customers acknowledge that laboratories require accurate identifying information in order to correctly process and report results.

19.3 Failure to provide accurate information may prevent a laboratory from processing a sample.

Notifiable Conditions

20.1 Certain laboratory findings may be subject to legal reporting requirements.

20.2 Where required by law, Easy Blood Check, its laboratory partners or healthcare providers may disclose relevant information to public health authorities or regulatory bodies.

20.3 Such disclosures may occur without additional consent where required by applicable legislation.

d) Doctor Review Services;

e) Health Screening Services;

f) Additional services introduced from time to time.

25.3 Services may be delivered directly by Easy Blood Check or through approved third-party providers.

25.4 Easy Blood Check reserves the right to amend, suspend, replace or withdraw any service without notice where reasonably necessary.

Test Kits

26.1 Certain services require the use of a testing kit supplied by Easy Blood Check.

26.2 Testing kits may include:

  • lancets
  • packaging materials
  • instructions
  • return packaging

26.3 Customers must use only the materials supplied with the testing kit unless expressly instructed otherwise.

26.4 Easy Blood Check accepts no responsibility for samples collected using alternative equipment or materials.

26.5 Customers should inspect testing kits upon receipt and notify Easy Blood Check promptly if any item appears damaged, incomplete or defective.

Finger Prick Testing

27.1 Certain tests may be completed using self-collected finger prick samples.

27.2 Customers must carefully follow all instructions supplied with the kit.

27.3 Failure to follow instructions may result in:

  • insufficient samples
  • contaminated samples
  • delayed results

inability to process samples.

27.4 Easy Blood Check cannot guarantee successful sample collection by every customer.

27.5 Easy Blood Check shall not be liable where a sample cannot be processed due to incorrect self-collection.

Venous Blood Collection

28.1 Certain tests require a venous blood sample collected by a suitably qualified healthcare professional.

28.2 Customers may be offered one or more of the following options:

a) arrange their own phlebotomy appointment;

b) attend an approved clinic;

c) arrange a Home Visit through Easy Blood Check.

28.3 Customers who arrange their own blood collection remain responsible for ensuring that the sample is collected by an appropriately qualified healthcare professional.

28.4 Easy Blood Check shall not be responsible for the quality of services provided by healthcare professionals independently selected by the customer.

Home Visits

29.1 Home blood collection services may be available throughout the United Kingdom, subject to location, availability and operational requirements.

29.2 Home Visits are provided through independent healthcare professionals supplied by approved healthcare agencies and service providers.

29.3 Appointment availability may vary depending upon:

  • geographical location
  • healthcare professional availability
  • laboratory requirements

customer availability.

29.4 Easy Blood Check will make reasonable efforts to arrange appointments within requested timeframes but does not guarantee appointment availability.

Independent Healthcare Professionals

30.1 Home Visits and certain blood collection services may be carried out by:

  • nurses
  • phlebotomists
  • healthcare assistants

other appropriately trained healthcare professionals.

30.2 Such individuals may be supplied through approved third-party healthcare agencies or service providers.

30.3 Where Easy Blood Check appoints or contracts with healthcare providers, it will take reasonable steps to ensure that those providers maintain, where applicable, appropriate:

  • qualifications
  • registrations
  • training
  • professional standards

insurance arrangements.

30.4 Healthcare professionals remain responsible for their own professional conduct and clinical decision-making.

Customer Responsibilities For Home Visits

31.1 Customers must ensure that:

a) the appointment address is accurate;

b) access to the property is available;

c) the healthcare professional can safely enter and leave the property;

d) a suitable area is available for sample collection;

e) adequate lighting is available;

f) pets are appropriately controlled.

31.2 Customers must notify Easy Blood Check of any circumstances that may affect safe attendance.

Health And Safety

32.1 Easy Blood Check and attending healthcare professionals reserve the right to refuse, postpone or terminate an appointment where:

a) there are safety concerns;

b) the environment is unsuitable for clinical procedures;

c) there is threatening, abusive or aggressive behaviour;

d) there is suspected intoxication;

e) there is a risk to health or safety.

32.2 Where an appointment is terminated for safety reasons, charges may still apply.

Attendance And Access

33.1 Customers must be present at the agreed appointment time unless alternative arrangements have been agreed.

33.2 Failure to provide access may result in:

  • cancellation of the appointment
  • rebooking fees

additional charges.

33.3 Easy Blood Check reserves the right to treat such circumstances as a missed appointment.

Appointment Times

36.2 Any such decision shall be made at Easy Blood Check’s reasonable discretion.

Delivery, laboratory testing and results

Dispatch Of Test Kits

37.1 Following acceptance of an order and successful payment, Easy Blood Check will arrange dispatch of any testing kit required for the selected service.

37.2 Testing kits will normally be dispatched within a reasonable period following order confirmation.

37.3 Estimated dispatch and delivery times are provided for guidance only and are not guaranteed.

37.4 Delivery times may vary due to:

a) courier availability;

b) postal service delays;

c) public holidays;

d) adverse weather conditions;

e) circumstances beyond our reasonable control.

37.5 Easy Blood Check shall not be liable for losses arising from delays caused by third-party delivery providers.

Delivery Of Test Kits

38.1 Delivery shall be deemed completed when a testing kit is delivered to the address supplied by the customer.

38.2 Customers are responsible for ensuring that delivery information is accurate.

38.3 Easy Blood Check shall not be responsible for failed deliveries resulting from incorrect information supplied by the customer.

38.4 Risk in the testing kit passes to the customer when the customer, or a person identified by the customer to receive the delivery, takes physical possession of the testing kit, subject to applicable consumer law.

Lost, Damaged Or Incomplete Test Kits

39.1 Customers should inspect testing kits upon receipt.

39.2 Any damage, defects or missing contents should be reported as soon as reasonably possible.

39.3 Easy Blood Check may provide replacement materials where appropriate.

39.4 Easy Blood Check reserves the right to request photographs or additional evidence before issuing replacements.

Sample Collection Requirements

40.1 Customers must carefully follow all instructions supplied with their testing kit or appointment confirmation.

40.2 Certain tests may require:

  • fasting
  • collection at a specified time
  • avoidance of alcohol
  • medication restrictions

other preparation requirements.

40.3 Failure to comply with preparation requirements may affect the reliability of results.

40.4 Easy Blood Check accepts no responsibility for inaccurate results arising from failure to follow preparation instructions.

Return Of Samples

41.1 Customers are responsible for ensuring that samples are returned in accordance with the instructions supplied.

41.2 Finger prick samples should normally be returned on the same day as collection unless alternative instructions are provided.

41.3 Samples should be packaged and posted in accordance with all instructions provided.

41.4 Delays in returning samples may affect sample integrity and testing accuracy.

Sample Stability

42.1 Certain samples remain stable only for limited periods of time.

42.2 Delays during collection, storage or transportation may result in deterioration of the sample.

42.3 Easy Blood Check accepts no responsibility for sample deterioration caused by delays outside our reasonable control.

Laboratory Analysis

43.1 Samples submitted through Easy Blood Check are analysed by accredited laboratory providers.

43.2 Laboratory services may be provided by Inuvi and/or other approved laboratory partners.

43.3 Easy Blood Check does not perform laboratory analysis itself.

43.4 Laboratory providers are responsible for conducting testing in accordance with their professional and regulatory obligations.

Laboratory Rejection Of Samples

44.1 A laboratory may reject a sample for testing where:

a) insufficient sample volume has been collected;

b) the sample has deteriorated;

c) the sample has clotted;

d) the sample has haemolysed;

e) the sample has been incorrectly labelled;

f) laboratory requirements have not been met.

44.2 Where a laboratory refuses to process a sample because of sample quality, Easy Blood Check will assess the circumstances and any remedy in accordance with these Terms, the Refund & Cancellation Policy and the customer’s statutory rights. Nothing in this clause excludes liability where it would be unlawful to do so.

Failed Samples

45.1 From time to time a sample may be unsuitable for analysis.

45.2 Reasons may include:

  • insufficient blood volume
  • clotting
  • haemolysis
  • contamination
  • transportation delays

laboratory processing issues.

45.3 Easy Blood Check may, at its discretion, offer:

a) a replacement testing kit;

b) a repeat sample request;

c) partial refund;

d) full refund;

e) account credit.

45.4 The appropriate remedy shall be determined on a case-by-case basis.

Repeat Samples

46.1 Where a repeat sample is required, Easy Blood Check may provide further instructions to the customer.

46.2 Customers may be required to provide a new sample before testing can be completed.

46.3 Easy Blood Check reserves the right to determine whether repeat testing is clinically appropriate.

Customer-Arranged Phlebotomy

47.1 Where customers independently arrange blood collection, they remain responsible for:

  • arranging a qualified healthcare professional
  • ensuring proper sample collection

ensuring timely sample return.

47.2 Easy Blood Check shall not be responsible for costs incurred through independently arranged phlebotomy services.

Home Visit Sample Collection

48.1 Samples collected during Home Visits may be handled and returned in accordance with procedures used by the attending healthcare professional or agency provider.

48.2 Customers should follow any instructions provided by the attending healthcare professional.

Turnaround Times

49.1 Estimated turnaround times displayed on the website are indicative only.

49.2 Turnaround times represent estimates and are not guaranteed.

49.3 Delays may occur due to:

  • laboratory workload
  • sample quality issues
  • repeat testing requirements
  • transportation delays
  • public holidays

events outside our reasonable control.

49.4 Easy Blood Check will not be responsible for delays caused by events outside its reasonable control, but this does not affect any statutory rights or any liability that cannot lawfully be excluded.

Test Results

50.1 Results will normally be provided electronically.

50.2 Results may be delivered through:

a) customer portals;

b) secure electronic reports;

c) downloadable PDF documents;

d) other secure methods determined by Easy Blood Check.

50.3 Customers are responsible for reviewing their results.

Doctor Comments And Interpretation

51.1 Doctor comments or interpretation may be included with a selected test or offered as an additional service, as stated on the relevant product or service page.

51.2 Such comments are intended to assist understanding of laboratory findings.

51.3 Comments do not constitute a formal diagnosis.

51.4 Additional clinical assessment may be required.

Results Without Doctor Review

52.1 Where a product or service is offered without Doctor Review, the customer will receive the laboratory results in the format described for that service.

52.2 Customers receiving results without Doctor Review remain responsible for seeking medical advice where appropriate.

52.3 Easy Blood Check strongly recommends discussing abnormal, unexpected or concerning results with a GP or suitably qualified healthcare professional.

Urgent Or Critical Results

53.1 In certain circumstances laboratory findings may indicate a potentially significant health concern.

53.2 Easy Blood Check reserves the right to attempt to contact customers where urgent action may be appropriate.

53.3 Easy Blood Check does not guarantee successful contact with customers.

53.4 Customers are responsible for ensuring their contact details remain accurate and up to date.

Limitations Of Test Results

54.1 Laboratory testing forms only one part of a wider clinical assessment.

54.2 Results should not be relied upon in isolation.

54.3 Additional testing, medical examination or specialist assessment may be required.

54.4 Easy Blood Check does not guarantee that any test will identify, diagnose or exclude any particular medical condition.

Pricing, cancellation and refunds

55.1 All prices displayed on the Easy Blood Check website are shown in Pound Sterling (£).

55.2 Prices may include:

  • administrative fees

  • Doctor Review services
  • Home Visit services

delivery charges where applicable.

55.5 Any change in pricing shall not affect orders that have already been accepted and paid for.

55.6 All prices include VAT where applicable.

56. Additional Services

56.1 Certain services may be offered as optional additions to a customer’s order.

56.2 These may include:

  • Home Visits
  • Doctor Reviews
  • priority services
  • enhanced reporting
  • additional consultations

future healthcare services introduced by Easy Blood Check.

56.3 Additional services may attract separate charges.

56.4 Charges for optional services will be displayed before purchase.

57. Customer Cancellation Rights

57.1 Where the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply, customers will normally have a legal right to cancel a distance contract within fourteen (14) days without giving a reason.

57.2 For goods, the cancellation period normally ends 14 days after the day on which the customer, or a person nominated by the customer, receives the goods. For services, the cancellation period normally ends 14 days after the contract is entered into.

57.3 Easy Blood Check may offer a more generous commercial cancellation period from time to time. Any additional commercial cancellation right does not reduce or replace statutory rights.

57.4 Cancellation requests may be submitted using the contact details published by Easy Blood Check. A customer does not have to use a particular form, provided the decision to cancel is communicated clearly.

58. Cancellation Before Dispatch

58.1 Where a valid cancellation request is received before a testing kit has been dispatched and no requested service has begun, the customer will normally receive a full refund.

58.2 Where the customer expressly requested that a service begin during the statutory cancellation period, the customer may be required to pay a proportionate amount for services supplied before cancellation, where permitted by law and where the required pre-contract information was provided.

59. Cancellation After Dispatch

59.1 Dispatch of a testing kit does not by itself remove any statutory cancellation right that applies to the order.

59.2 Where a customer validly cancels an order for goods, the customer must return the goods in accordance with the return instructions and within the period required by law.

59.3 The customer may be responsible for the direct cost of returning goods where this was disclosed before purchase. Easy Blood Check may make a lawful deduction for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

60. When The Right To Cancel May Be Lost Or Excluded

60.1 Statutory cancellation rights are subject to legal exceptions. Depending on the product or service, this may include sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed, where the statutory conditions for that exception are met.

60.2 For services, the statutory right to cancel may be lost once the service has been fully performed during the cancellation period where the customer expressly requested early performance and acknowledged that the right to cancel would be lost on full performance, where required by law.

60.3 Collection or submission of a biological sample, commencement of laboratory work, a completed Home Visit or a completed Doctor Review may affect the remedies available, but Easy Blood Check will apply the law to the circumstances of the particular order rather than treating these events as an automatic exclusion of statutory rights.

60.4 Nothing in these Terms limits a customer’s rights in relation to faulty goods, services not provided with reasonable care and skill, or any other rights that cannot lawfully be excluded.

61. Test Validity Expiry

61.1 Testing kits must be used within the validity period stated by Easy Blood Check.

61.2 Unless otherwise stated, testing kits remain valid for 120 days from the date of purchase.

61.3 Expired testing kits may not be processed.

61.4 Easy Blood Check shall not be obliged to provide refunds for expired tests.

62. Home Visit Cancellations

62.1 Home Visit appointments may be cancelled or rearranged without charge where sufficient notice is provided.

62.2 Easy Blood Check reserves the right to apply cancellation or rebooking charges where:

  • insufficient notice is given
  • the customer fails to attend
  • access to the property is not available

the healthcare professional is unable to safely complete the appointment.

62.3 Current cancellation charges may be published separately on the website.

62.4 Easy Blood Check reserves the right to amend Home Visit cancellation charges from time to time.

63. Missed Appointments

63.1 Customers are responsible for attending appointments at the agreed time.

63.2 Failure to attend an appointment may result in:

  • loss of appointment fees
  • rebooking charges

additional service charges.

63.3 Easy Blood Check reserves the right to require full payment before a replacement appointment is arranged.

64. Refund Process

64.1 Where a statutory refund is due following cancellation, Easy Blood Check will process it within the period required by applicable law. For goods, this will normally be within 14 days after receiving the returned goods or evidence that they have been sent back, whichever is earlier, subject to the applicable rules. For services, refunds will normally be made within 14 days after being informed of a valid cancellation.

64.2 Refunds will normally be issued using the same payment method used for the original transaction unless the customer expressly agrees otherwise.

64.3 Where required by law, the refund will include the standard outbound delivery charge. Additional delivery costs chosen by the customer above the least expensive standard delivery option need not be refunded where the law permits.

64.4 Outside statutory refund rights, Easy Blood Check may, where appropriate, offer account credit, replacement services, replacement testing kits or another agreed remedy.

65. Failed Sample Refunds

65.1 Where a sample cannot be analysed due to laboratory or operational reasons, Easy Blood Check may determine an appropriate remedy.

65.2 Remedies may include:

a) replacement testing kits;

b) repeat sample collection;

c) partial refunds;

d) full refunds;

e) account credits.

65.3 The remedy offered shall depend upon the circumstances of the case.

66. Promotional Offers

66.1 Easy Blood Check may offer discounts, promotional codes or special offers from time to time.

66.2 Promotional offers may be subject to separate terms and conditions.

66.3 Easy Blood Check reserves the right to withdraw or amend promotional offers at any time.

66.4 Promotional discounts cannot normally be applied retrospectively.

67. Gift Cards And Account Credit

67.1 Easy Blood Check may offer gift cards, vouchers or account credits.

67.2 Separate terms may apply to such products.

67.3 Gift cards and account credits are not redeemable for cash unless required by law.

68. Statutory Rights

68.1 Nothing within these Terms and Conditions shall affect any rights granted to consumers under applicable law.

68.2 Customers retain all statutory rights available under consumer protection legislation.

68.3 Where any provision of these Terms is found to be unenforceable, the remainder shall remain in full force and effect.

Liability and legal matters

69. Limitation Of Liability

69.1 Easy Blood Check will provide its services with the level of care and skill required by applicable law. Healthcare and laboratory services cannot guarantee a particular clinical outcome.

69.2 Easy Blood Check is responsible for losses that are a foreseeable result of its breach of contract or failure to use reasonable care and skill. It is not responsible for losses that are not reasonably foreseeable, subject always to the rights and protections that cannot lawfully be excluded.

69.3 Easy Blood Check will not be responsible for delay, failure or loss to the extent caused by circumstances outside its reasonable control, including postal or courier disruption, laboratory disruption or information supplied incorrectly by the customer. This does not exclude responsibility where Easy Blood Check remains legally responsible for the relevant act, omission, supplier or subcontractor.

69.4 Laboratory testing forms only one element of a wider healthcare assessment and should not be relied upon as the sole basis for medical decisions where further professional assessment is appropriate.

69.5 No test can guarantee the diagnosis, exclusion or prediction of every medical condition.

70. Healthcare Professionals And Third-Party Providers

70.1 Easy Blood Check may use laboratories, healthcare professionals, agencies, delivery providers, technology providers and other third parties in delivering its services.

70.2 Where a customer independently selects and contracts with a healthcare professional or phlebotomy provider outside the Easy Blood Check service, that provider is responsible for the services it supplies directly to the customer.

70.3 Where Easy Blood Check appoints a third party as its supplier or subcontractor, nothing in these Terms excludes any responsibility that Easy Blood Check has for that supplier or subcontractor under applicable law.

70.4 Healthcare professionals remain responsible for their own professional and clinical decisions, but this clause does not remove any legal rights the customer may have against Easy Blood Check or the healthcare professional.

71. Home Visit Services

71.1 Home Visits may be facilitated through appropriately qualified healthcare professionals and approved service providers.

71.2 The party legally responsible for providing the Home Visit will depend on the service arrangement described at the time of booking.

71.3 The attending healthcare professional remains professionally responsible for clinical procedures and decisions made during the appointment.

71.4 Nothing in this clause excludes any liability that Easy Blood Check may have under applicable law in relation to arranging or supplying the Home Visit service.

72. Test Results

72.1 Easy Blood Check does not guarantee that:

  • test results will identify all medical conditions
  • test results will always be available within estimated turnaround times

test results will eliminate the need for further medical assessment.

72.2 Test results should be considered alongside symptoms, medical history and advice from appropriately qualified healthcare professionals where appropriate.

72.3 Customers remain responsible for seeking medical advice where symptoms, results or other circumstances indicate that further assessment is required.

73. Liability That Cannot Be Limited

73.1 Nothing in these Terms excludes or limits liability for:

a) death or personal injury caused by negligence;

b) fraud or fraudulent misrepresentation;

c) breach of statutory rights that cannot lawfully be excluded or restricted;

d) any other matter for which liability cannot legally be limited or excluded.

73.2 Any other limitation or exclusion in these Terms applies only to the extent permitted by law and must be read consistently with the Consumer Rights Act 2015 and other applicable consumer protection legislation.

74. Customer Responsibility

74.1 Customers are responsible for:

  • selecting tests that meet their intended purpose
  • following testing and preparation instructions
  • attending booked appointments
  • submitting samples within applicable validity periods
  • providing accurate information

seeking medical advice where appropriate.

74.2 Easy Blood Check is not responsible for loss caused solely by a customer’s failure to meet these responsibilities, except where the law provides otherwise.

75. Statutory Rights And Fairness

75.1 Nothing in these Terms affects the customer’s statutory rights.

75.2 If any exclusion or limitation would be unfair or unenforceable under consumer protection law, it will not apply to the extent that it is unfair or unenforceable.

76. Events Outside Our Control

76.1 Easy Blood Check shall not be liable for failure or delay in performing obligations where such failure or delay results from events beyond our reasonable control.

76.2 Such events may include:

  • severe weather
  • industrial disputes
  • transport disruption
  • postal disruption
  • pandemics
  • public health emergencies
  • government action
  • utility failures
  • cyber incidents
  • laboratory disruption

shortages of staff or materials.

76.3 Where reasonably possible, Easy Blood Check will notify affected customers and take reasonable steps to minimise disruption.

77. Changes To Services

77.1 Easy Blood Check reserves the right to amend, suspend or discontinue services where reasonably necessary.

77.2 Such changes may be required due to:

  • operational requirements
  • regulatory changes
  • clinical requirements
  • supplier changes

technological developments.

78. Changes To These Terms

78.1 Easy Blood Check may amend these Terms from time to time.

78.2 The version in force at the time an order is placed shall normally apply to that order.

78.3 Updated Terms will be published on the Easy Blood Check website.

79. Transfer Of Rights

79.1 Easy Blood Check may transfer, assign or subcontract any rights or obligations under these Terms.

79.2 Such transfer shall not adversely affect customer rights.

80. Third-Party Rights

80.1 Unless expressly stated otherwise, no person who is not a party to these Terms shall have any right to enforce any provision under the Contracts (Rights of Third Parties) Act 1999.

81. Severability

81.1 If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions shall remain fully effective.

82. Waiver

82.1 Failure by Easy Blood Check to enforce any right shall not constitute a waiver of that right.

82.2 Any waiver must be made in writing.

83. Complaints

83.1 Customers may submit complaints using the contact details published on the Easy Blood Check website.

83.2 Easy Blood Check will investigate complaints fairly and within a reasonable timeframe.

83.3 A separate Complaints Procedure may apply.

84. Governing Law

84.1 These Terms and Conditions are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply in the part of the United Kingdom where the customer lives.

84.2 If the customer lives in England or Wales, proceedings may be brought in the courts of England and Wales.

84.3 Customers resident in Scotland or Northern Ireland may bring proceedings in the courts available to them under applicable consumer law. Nothing in this clause removes any mandatory right to bring proceedings in the customer’s home jurisdiction.
